5. Payments and Refunds If you purchase any paid products or services through DoctorDigital.io,

you agree to pay all fees and charges associated with those purchases. All payments are non-

refundable unless otherwise stated. We may change prices at any time; changes will not affect

orders already accepted.

6. Disclaimers & Limitation of Liability THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,”

WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW,

DoctorDigital.io DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY,

FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW

IN NO EVENT SHALL DoctorDigital.io OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS

BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF

PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE

SERVICES. DoctorDigital.io’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO

THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID DoctorDigital.io IN THE

PRIOR 12 MONTHS (OR, IF NO PAYMENTS, $100 USD).

7. Indemnification You agree to indemnify, defend, and hold harmless DoctorDigital.io, its

affiliates, and their officers, directors, employees, and agents from and against any claims,

liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from

your use of the Services or your violation of these Terms.

8. Termination We may suspend or terminate your access to the Services, without notice or

liability, for any reason, including breach of these Terms. Upon termination, your right to use

the Services stops immediately. Provisions that by their nature should survive termination

(such as intellectual property, disclaimers, limitation of liability, and indemnification) will

survive.

9. Governing Law & Dispute Resolution These Terms are governed by and construed in accordance

with the laws of the State of New Jersey, United States, without regard to conflict of laws

principles. Any dispute between you and DoctorDigital.io arising out of or relating to these

Terms or the Services shall be resolved exclusively in the state or federal courts located in

New Jersey, and you consent to personal jurisdiction and venue there.

10. Changes to Terms We may modify or update these Terms at any time, in our sole discretion.

When we do, we will post the revised Terms on our site with the “Last updated” date. Your

continued use of the Services after the changes indicates your acceptance of the updated Terms.

11. Miscellaneous – Severability: If any provision of these Terms is held invalid or

unenforceable, the remaining provisions remain in full force and effect. – Waiver: No waiver by

us of any right under these Terms shall be deemed a further or continuing waiver. – Assignment:

You may not assign your rights or obligations under these Terms without our prior written

consent. We may assign to any successor. – Entire Agreement: These Terms, along with any other

legal notices or policies posted on the Services, constitute the entire agreement between you

and DoctorDigital.io concerning the Services.
